BvD’s own gGmbH for charitable projects – donations tax-deductible

In addition to its core tasks as a professional association, the BvD has long been committed to promoting awareness of data protection in society. This is currently being done with the “Data protection goes to school” (DSgzS) initiative and the Data Protection Media Award (DAME), which were and are made possible by generous donations from various sponsors – above all the DATEV Foundation Future.

Previously, the BvD had to tax these donations as income due to the lack of non-profit status and was therefore unable to allocate one hundred percent of them to the good cause. This situation has changed with the founding of privacy4people – Gesellschaft zur Förderung des Datenschutzes gGmbH (P4P gGmbH). It not only pursues educational purposes, but also supports the promotion of science and research and the strengthening of consumer protection. Any existing and new BvD projects that promote one or more of these purposes can be supported by P4P gGmbH on a tax-privileged basis.

For the work of the BvD and its working groups, in particular the school working group, the establishment of P4P gGmbH does not change anything operationally. For sponsoring companies and private individuals, however, it has the advantage that donations can be collected and certified as donations – an important argument for donors who need these receipts for their own tax returns.

The BvD is the sole shareholder of P4P gGmbH and has appointed an honorary managing director from the ranks of the Board of Directors. P4P gGmbH is a non-profit organization. All profits generated by it are allocated to and used for the purposes described. Any disbursement of surpluses to the BvD as an association not recognized as a non-profit organization for use for other purposes is excluded.

Processing in the context of fundraising

For the purpose of collecting donations for eligible purposes, privacy4people – Gesellschaft zur Förderung des Datenschutzes gGmbH processes personal data of donors and their representatives (in particular names, contact details and payment information) for a specific purpose, insofar as this is necessary for the purpose.

The associated data processing is carried out in accordance with and in compliance with Art. 6 para. 1 lit. b GDPR.

Processing for the purposes of the non-profit organization

As a non-profit limited liability company, privacy4people – Gesellschaft zur Förderung des Datenschutzes gGmbH pursues certain purposes worthy of support according to the German Tax Code (Abgabenordnung) in accordance with its articles of association. In particular, privacy4people – Gesellschaft zur Förderung des Datenschutzes gGmbH currently supports and operates the initiative “Datenschutz geht zur Schule” (DSgzS) and the Datenschutz Medienpreis (DAME) .

As part of the “Data protection goes to school” initiative (DSgzS), personal data, such as names and contact details of contact persons, are processed for the purpose of organizing training and awareness-raising events and for the purpose of establishing contact and planning events in accordance with Art. 6 para. 1 lit. b GDPR.

The annual Data Protection Media Award (DAME) is in turn associated with the submission of applications and related personal data, in particular the processing of name, address, contact details, job title and details of the contribution, which are processed by privacy4people – Gesellschaft zur Förderung des Datenschutzes gGmbH and the jury selected by it and the Berufsverband der Datenschutzbeauftragten Deutschlands (BvD) e. Security of your personal data

privacy4people – Gesellschaft zur Förderung des Datenschutzes gGmbH, together with the BvD, uses technical and organizational security measures to protect your data from access and misuse by unauthorized persons. When data is transmitted, this data is protected by the use of encryption, such as the TLS protocol (Transport Layer Security). These security measures are adapted in line with technological developments and in accordance with the relevant legal provisions.

Rights of data subjects

Data subjects may request confirmation as to whether personal data concerning them is being processed. If such processing is taking place, they can obtain information about the purpose, the data, the origin of the data, recipients of data (including international transfers) and the duration of storage.

In addition, users have the right to correct incorrect data, restrict processing and delete their personal data. Consent can be revoked at any time by contacting the office.
