• The BDSG as an important legal basis for the data protection officer in Germany

Data protection officers perform important functions in companies and public authorities. Their work is regulated in the General Data Protection Regulation (GDPR) and, in Germany, in the Federal Data Protection Act (BDSG).

Many tasks in the area of data protection are carried out by specialists such as lawyers, industrial engineers, IT experts and other experts with different backgrounds. This ensures that the different perspectives and requirements are taken into account when performing these tasks.

After the federal state of Hesse introduced the world's first data protection law in 1970, the BDSG celebrated its premiere as national legislation in 1977. Since the GDPR came into force in 2018, the BDSG has supplemented the European General Data Protection Regulation, in particular with the regulation on when the appointment of a data protection officer is mandatory for a company.

"The BDSG specifies and supplements the general provisions of the GDPR at the national level. Data protection officers and companies alike benefit from these clarifications because they ensure effective data protection in Germany and clearly define the rights and obligations of all parties involved.

The BDSG provides important guidelines for data protection officers in public bodies in particular for their work as official data protection officers."
